1. Eligibility and Account Registration
Only adults (18 years or older) acting as parents, legal guardians, or teachers may register for a Lernaido account. Each user must provide accurate and complete information during registration. Accounts may only be used by the registered user; sharing account credentials is strictly prohibited. Children are permitted to use the Service only under the supervision of a parent, guardian, or teacher.
2. Service Description
Lernaido provides educational support, including AI-based homework correction, explanations, progress tracking, and the generation of curriculum-aligned sample exams. Service features and supported subjects may change from time to time. We will provide reasonable notice of any significant changes that affect the functionality of the Service.
3. User Content and Uploaded Materials
Users may upload homework assignments and related materials for the purposes of correction and feedback. Uploaded images are processed and routed through our AI systems. Original images are stored to provide our service; extracted text, analysis results, and limited metadata (such as user ID, region, and grade) are also retained. Users agree not to upload content that is unlawful, offensive, or violates intellectual property rights.
You may request the deletion of any uploaded data or metadata associated with your account or your child by deleting your account. All images and data are deleted when a user account is deleted upon request.
4. Children's Privacy and Data
Child names are not required and may be replaced with nicknames or pseudonyms. Lernaido minimizes the collection of personal data related to children and complies with all applicable child data protection laws, including the General Data Protection Regulation (GDPR) and the Children's Online Privacy Protection Act (COPPA), where applicable.
Parental or guardian consent is required before any personal information is collected from or about children. We do not knowingly collect personal data from children under the age of 13 without verified parental consent.
You may request the deletion of any personal or educational data associated with your child at any time by deleting your account.
5. User Obligations and Restrictions
You must not misuse the Service, including but not limited to: reverse engineering, unauthorized data access, distribution of malicious software, or use for any unlawful purposes. You may not attempt to circumvent or disable any security features of the Service.
6. Email Verification and Communication
Email addresses provided during registration must be validated via a confirmation link. By registering, you agree to receive essential service notifications and legal updates via email. You may opt out of non-essential communications at any time.
7. Intellectual Property
All Lernaido software, content, logos, and trademarks are owned by Lernaido or its licensors. Users are granted a non-exclusive, non-transferable right to use the Service for personal, educational purposes only.
8. Term and Termination
The subscription runs for an indefinite period and can be canceled by either party at any time to the end of the current billing period. We also reserve the right to suspend or terminate accounts immediately for cause, including for any breach of these Terms or misuse of the Service. Users may delete their accounts at any time by contacting support. Upon account deletion, personal and child-related data will be removed in accordance with our data retention policies.
9. Disclaimers and Limitation of Liability
Lernaido offers educational assistance but does not guarantee academic outcomes, grades, or the correctness of all information provided. The Service is intended for supplemental educational use and does not replace certified teaching, tutoring, or formal educational evaluation.
The Service is provided "as is" and "as available." To the extent permitted by law, Lernaido disclaims all warranties, including implied warranties of fitness for a particular purpose. To the maximum extent permitted by applicable law, Lernaido shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service.
10. Price Adjustments and Changes to Terms
We are entitled to change these Terms and prices with effect for the future. We will notify you of any changes at least four weeks before they are scheduled to take effect in text form (e.g., by email). You have the right to object to the change within four weeks of receiving the notification. If you do not object within this period, the change is deemed accepted. We will specifically draw your attention to this consequence in the notification. If you object to the change, we have the right to terminate the contract ordinarily at the time the change takes effect or at the next possible termination date.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of that country.
